getting sued for Selling a car?

Cletus Makler: Signed contracts outweigh verbal in any court. Probably .

Travis Colomb: no. regardless of signed contract, Mr. Morales did not try to sell the property to another party for the same or greater amount, but shorted himself. However, Mr. Rodriguez may sue Mr. Morales for specific performance if he decides he wants the car and the two did not cancel the original contract in writing.

Lonnie Jehle: Why would Rodriguez be responsible for the $2900?Rodriguez, if he were smart, would have cancelled the contract in writing.Morales obviously doesn't recognize his own contract to Rodriguez to buy the car anymore, because he's sold it to someone else. The fact that Morales gave his brother-in-law a favor by selling his car below market value doesn't affect Rodriguez. What if he gave the car to his brother-in-law for free? Should he sue for $3000? Of course not....Show more

Maye Delk: No

Robt Betker: No. Morales has not reasonably attempted! to mitigate his damages for selling the car to someone else at its fair market value. Dana (attorney)
